    <h1>Birthday Buddy Terms of Service</h1>
           <h2>A - Preface</h2>
<p>
By using any of BdayBud's services, the Fully Automated BdayBud Scheduler (the FABS) and the Birthday Buddy Extension (the Extension), you (the User) agree to every thing listed in the Terms of Service (the Document). If at any point the User disagrees with any part of the Document, the User agrees to immediately delete and refrain from using any Service that BdayBud provides. For assistance, comments, and/or questions you may contact the Creator anytime at: info@bdaybud.com (Responses to queries received by Birthday Buddy via email are typically responded to within 24 business hours. If it has been longer than that, please reach out again).

<h2>I - Mission</h2>
<p>
BdayBud's main goals are:
</ul>
<li>Securing all confidential information using best-practice security measures</li>
<li>Saving the User time.</li>
<li>Making the User's friends feel good and unforgotten on their birthdays.</li>
<li>Make the User feel good knowing the User's friends feel good.</li>
<li>Update BdayBud with new Services and improve Services with better features to better fit Users' needs.</li>


<h2>II - Acknowledgment</h2>
<p>
The BdayBud is in no way affiliated with any other external service at this time. All third-party companies can change their code-base(s) as they see fit. The Service(s) may stop working at any time due to this fact. The User agrees to notify the Creator when any bugs are noticed so that the Creator may provide fixed and stable Service(s) to all Users.</p>
<h2>III - Services Functionality</h2>
<p>
FABS (paid): User validates a third-party service with BdayBud and creates a schedule (validation may require the user to change the third-party service's password to complete successfully. This step, if necessary, is due to third-party's security measures. BdayBud will walk you through the process if necessary). Each day, within a few minutes of the time period set in your schedule, FABS will wish all friends whose birthday is today on that third-party service using one of your customized birthday messages. Once the schedule is set up, the User need not log in to the third-party service for the wishes to be sent. This is the Fully Automated, Hands-Free, set it and forget it version of Birthday Buddy.</p>
<p>
Extension (free): Upon User's successful login to the third-party service, clicking on the Birthday Buddy link, and clicking on "Apply Messages," the Extension iterates through the User's list of friends whose birthday is today and auto-populates a message. User may then modify the message as the User sees fit. Then the User may click on "Send Wishes" button for messages to be automatically sent. This implies that user has already generated up to their max number of customized birthday wishes in the Bday Buddy Configurations.</p>
<p>
Extension (paid): Same as Free, but more! There is an option that may be turned on (in Bday Buddy Configurations) that as soon as the User clicks the Birthday Buddy link, and as soon as the mouse is moved on the next page, the messages get automatically created and sent to the User's friends whose birthdays are today.</p>

<h2>IV - Updates</h2>
<p>
The Services' functionality may be updated at any time for a number of reasons which include, but are not limited to: bugs, features, updates, upgrades, changes to third-party service's code, improvements, rollbacks... It is the User's responsibility to keep up to date with updates to the Terms of Service. If at any time the User feels a supported Service is lacking in functionality, ease of use, or other, the User agrees to notify the Creator.

<h2>V - Privacy</h2>

<p>FABS: saves the information the User supplies when registering a BdayBud account; User supplied first and last name, email, and password. Your information is kept safe and will not be distributed. The password the User creates the account with is obfuscated (It is recommended not to use the same password from another service). Once a paid member acknowledges the understanding of this full document, a Schedule may be made for a third-party service. BdayBud saves the obfuscated version of the User's credentials to the third-party service; great caution is taken to ensure safety and protection of these credentials. Nobody possesses the ability to decrypt these messages nor assume control over the services which can. Two-Factor Authentication, a Key Management Service, Rotating keys, and Private Networks where the decryptions occur are used to ensure this top level of security. For questions or concerns, please contact the Creator. The Creator suggests you do not share your third-party credentials with anyone unless you trust them and understand what and how they are used. Even then, great caution should be taken to ensure you are on the correct Website (check the domain name) and are using secure protocols. If there is any concern whatsoever, please contact the Creator to discuss.</p>

<p>Extension (free and paid): saves only the information the User supplies when registering a Birthday Buddy account; User supplied first and last name, email, and password. Your information is kept safe and will not be distributed. The password the User creates the account with is obfuscated (It is recommended not to use the same password from another service). The Extension does not save any personal or public information from the User's third-party service's account or the User's machine; The User's sensitive credentials to the third-party service are not logged nor saved by the Extension. The Extension only goes to work once the User physically logs onto the third-party service on the User's own accord, the User is logged into the Extension, and the user has created at least one custom birthday message.</p>

<h2>VI - Pictures</h2>
<p>Users of the FABS are able to upload one picture for each message. If a user uploads a picture to a messages and saves it, the FABS will use only messages with pictures when sending birthday wishes on your behalf. Users agree no illicit, offensive, nudity-filled, nor derrogative images will be uploaded using BdayBud's services. User should only upload photos he/she has the rghts to. BdayBud reserves the right to remove any User's photos from the system and to block a User from being able to use the pictures feature at any time for missconduct and/or other reasons. BdayBud will in the future utilize AI to scan the images to ensure they are clean. The definition of clean can be inferred to by this paragraph. This paragraph may change at any time to ensure the defintion of clean stays up-to-date with current rules and regulations. Attempting to upload malicious files will be taken as a serious offense and you will be reported to the authorities.</p>
<h2>VII - Software</h2>
<p>The Services may not be reverse-engineered by the User, or any one. The Creator reserves the rights to: all Services, the technology used to create them, and the ideas they implement.</p>
<h2>VIII - Subscription Cancelation</h2>
<p>
You may cancel your account at any time by sending an email to Support@bdaybud.com<br />Proof of account ownership will be necessary (sending an email from the account's registered email address is sufficient).
</p>
<h2>IX - Refund Policy</h2>
<p>
If you are a Subscribed User of Birthday Buddy, you may request for a refund (and cancelation) of your account by sending an email request to Support@bdaybud.com<br />
Your refund will be processed if the following is true:<br />
<ul>
    <li>It is a new billing cycle</li>
    <li>You have not used the Birthday Buddy Services in the new billing cycle and/or you no longer plan to use the Birthday Buddy Services.</li>
</ul>
</p>
<h2>X - Closing</h2>
<p>The User relinquishes all rights to find at fault BdayBud, its Services, and/or the Creator for any mishaps encountered during the use of any BdayBud related Service. The Services range from free to download and use to paid. BdayBud, The Creator, and the Services may not be taken to court for any litigations, whatsoever. BdayBud was not created for malicious purposes, nor will it ever be used as such. The Creator intends to improve the birthday wishing process on third-party services with BdayBud's Services and all the planned updates/upgrades. The security of the Users' information and the improvement of Birthday wishing is the Creator's number one goal.
